Yes and no.
If you are alone in a room with a girl, she gets naked and you take that as an invitation and jump her, i dont think a judge or jury is gonna condemn you for not asking xD
But if you jump her, she asks you to stop and you dont stop because you think she being naked is reason enough for you to fuck her, then thats rape.

If every time you tried to fuck someone without verbal confirmation was considered rape, then 99,99% of the girlfriends/boyfriends/wives/husbands would be in jail LOL
I guess it also depends on the country or the social sensitivity at that moment.
