Questions regarding the manga copyright issues

1. is reason why some manga are updated (compared to other manga like talentless nana) is because the community is the one translating it? and for example talentless nana since Crunchyroll is the one translating it manga dex is not downloading and reuploading it here so there will be no potential site take down that will occur due to copyright issues?

2.what happens if the community will do its own translation? like why wait for the license of Crunchyroll to stop if the community can just do it rather than waiting??
